Services

Ecom007 provides email and SMS marketing strategy, campaign management, automation buildout, and retention services for DTC ecommerce brands. The specific scope, deliverables, timeline, and fees for any engagement are set in a separate statement of work ("SOW"). These Terms govern the relationship. The SOW governs the engagement.

Payment

Fees, invoicing schedules, and payment terms are set in the SOW. Unless stated otherwise in the SOW, invoices are due within 15 days. Late payments may result in paused work after 7 days written notice.

No Guaranteed Results

Ecom007 provides strategy, creative, and technical execution. We do not guarantee specific revenue outcomes, open rates, click rates, or any other performance metric. Results depend on factors outside our control: product quality, offer strength, list health, brand reputation, market conditions, and platform deliverability. Past performance across our client portfolio does not guarantee future results for any individual engagement.

Intellectual Property

Our materials. Ecom007 owns all methodologies, frameworks, templates, and IP developed before or independently of your engagement — including the MONOPOLY Audit.

Your deliverables. Once you've paid in full for the relevant SOW, you own the campaign copy, flow designs, and creative assets produced for that engagement. Ecom007 may reference the work in our portfolio and case studies unless you ask us not to in writing.

Your data. All client-provided data — customer lists, store data, brand assets — stays yours. We use it only to deliver the contracted services and return or delete it when the engagement ends.

Confidentiality

Both sides keep any proprietary or sensitive information shared during the engagement confidential — campaign performance, revenue figures, customer data, pricing, unpublished strategy. This obligation survives termination for two years.

Limitation of Liability

To the maximum extent permitted by law, Ecom007's liability for any claim is limited to the fees you paid in the three months before the claim. We are not liable for indirect, consequential, or punitive damages — lost revenue, lost customers, or platform account issues from deliverability, compliance violations, or algorithm changes.

Platform Compliance

You are responsible for staying compliant with your email and SMS platform's terms of service (Klaviyo, Attentive, Postscript, etc.). We advise on compliance best practices, but you bear ultimate responsibility for your platform standing and sender reputation.

Termination

Either party may terminate per the notice period in the SOW. Ecom007 may terminate immediately if you breach payment terms, misrepresent your business, or engage in practices that risk platform or legal non-compliance. On termination, you pay all outstanding fees for work delivered through the termination date.

Governing Law

These Terms are governed by the laws of India. Disputes will be resolved through binding arbitration in Kolkata, West Bengal, unless we agree otherwise in writing.

Changes

We update these Terms as needed. Changes are effective when posted. Continuing to use the site or our services means you accept the updated Terms.
